1.Agreement
Vansha is operated by Smartsarks Pvt. Ltd. from Lalitpur, Nepal. You can reach us at [email protected]. By using the website, creating a community or accepting an invite, you agree to these terms. If you use Vansha for a Samaj, you confirm you are allowed to bind that community.
If a written plan agreement or order says something different about price, term or support, that written agreement applies for those points. These terms still apply to everything else.
2.The service
Vansha gives a community one place for its lineage, members, events and calendar, donations and accounting, Pustawali, messages and a public website. Features depend on the plan the community is on. We may add, change or retire a feature and we will not remove a core record type — members, tree or accounting entries you have already stored — without a way for you to export them.
3.Accounts and roles
- The person who starts a community is its first admin. Admins can invite managers and members and can decide what each role can see and edit.
- You are responsible for keeping your sign-in private and for activity under your account. Tell us promptly at [email protected] if you think someone else is using it.
- You must give accurate account details and keep them up to date.
- We may refuse a name, slug or public page that impersonates another community or that we cannot lawfully host.
4.Your community’s records
The community owns the records it enters: family relationships, member details, photos, events, accounts and pages. You give us permission to host, back up and display those records so the product can work, including showing a public page to anyone if an admin publishes it.
The community admin is responsible for the accuracy of those records and for having permission to store information about living people, including children. Do not enter information you are not allowed to keep. A person asking for a correction or removal should be directed to the community admin; we will step in if the community does not respond, as described in the privacy policy.
5.Acceptable use
Use Vansha for a real community. You agree not to:
- Break the law of Nepal or infringe someone else’s privacy or intellectual property.
- Upload content that is defamatory, hateful or sexually exploitative or that puts a child at risk.
- Probe, scrape or overload the service or try to access another community’s records.
- Send spam or use member contact details for a purpose the community did not agree to.
- Misrepresent accounts, donations or attendance.
- Resell Vansha or share one login across people who were not invited.
6.Plans, trials and payment
- Plans and prices are shown on the pricing page. A plan may start with a free trial. We charge only if you choose to continue after the trial.
- Fees are billed in advance, monthly or annually, as you select. Annual plans are a single payment for twelve months at the discounted rate shown.
- We accept eSewa, Khalti, connectIPS, bank transfer and Visa or Mastercard. An annual plan can be invoiced for committee approval before payment.
- You can upgrade at any time. We prorate the difference. A downgrade applies at the start of the next billing period.
- If a community grows past the member limit of its plan, we will ask you to upgrade. We will not delete member records because a limit was reached.
- Fees already paid are not refunded except where Nepal’s law requires it or where we cancel the service ourselves without cause. You can cancel renewal before the next billing date and keep access until the period you paid for ends.
7.Public community websites
A community’s public website is visible to anyone the community shares it with. The community is responsible for what it publishes, including photos of people and notices about events or funds. Vansha may remove a public page that breaks these terms or the law and will tell the community admin when we do.
8.Your content
You keep ownership of the text, photos and records you submit. You grant Vansha a licence to store, reproduce and display that content only as needed to provide the service, to make backups and to show what you or your community publish. This licence ends when the content is deleted, except for copies we must keep for a legal duty or that remain in a backup until that backup expires.
You can export your community’s records while the account is active. Write to [email protected] if you need help with an export before you close the account.
9.Our content
Vansha, the Vansha name and mark, the product design and the software remain ours or our licensors’. These terms do not give you ownership of the product. You may not copy the software, the marketing site or our branding, except for a community using the product as intended.
10.Suspension and ending access
You may close a community account by writing to us. We may suspend or close an account if fees are overdue, if these terms are broken or if we must do so to meet the law. Where we can, we will warn the community admin first and give a chance to export records.
If we discontinue Vansha entirely, we will give community admins reasonable notice and a way to export their records.
11.Disclaimers
Vansha is a record-keeping tool. It does not decide family relationships, inheritance, citizenship or the official accounts of a Samaj. Genealogy, attendance and financial reports are only as complete as the information a community enters. You should keep your own copies of records that matter for a legal or ceremonial purpose.
The website and the platform are provided with reasonable care. We do not promise that they will be uninterrupted or free of errors. Features shown on this marketing site may depend on the plan you choose.
12.Liability
To the extent Nepal’s law allows, Vansha is not liable for lost profits, lost goodwill or indirect loss or for a community’s own records being incomplete or wrong. Our total liability arising out of the service in any twelve-month period is limited to the fees that community paid us in that period. This limit does not apply to liability that the law does not allow us to limit, including liability for fraud or for death or personal injury caused by our negligence.
13.Governing law
These terms are governed by the laws of Nepal, including the Electronic Transactions Act, 2063 and the Individual Privacy Act, 2075. The courts of Kathmandu have jurisdiction, except where a consumer law gives you the right to bring a claim somewhere else.
14.Changes to these terms
We may update these terms. The new version will be posted on this page with a new date. If a change is material, we will tell community admins by email or in the product before it applies. Continuing to use Vansha after the new date means you accept the update.
15.Contact
Questions about these terms can be sent to [email protected].
